WHAT IS PRIVACY INFORMATION?
Information for you about why and how your personal data is processed by us. When I say Marley & the Wildlings, I also mean Marley and The Wildlings Photography or Lauren Heaton.
BACKGROUND INFORMATION:
Marley & the Wildlings was founded in 2019 but started in 2025 and is registered at The Poplars, Newark Road, Wellow, Newark, NG22 0EA as a sole trader.
I am registered as a data controller with Information Commission and our registration reference is: TBC, proof can be provided that I have registered if you contact me on dpo@marleyandthewildlingsphoto.com
My business is to take photographs of weddings & events, families, newborns and maternity, but able to adapt to all types of professional photography. Individuals who wish their photographs to be taken can book with me using my website link to fill out a booking form.
On some occasions, I am a second photographer for other photography organisations, of which the photos I take using my equipment belong to them.
I do not share information outside of Marley & the Wildlings and any contractors who assist us, provided they have completed an NDA. Data protection law gives you rights, and I want to make sure I’m doing right by you. The sections below describe how your personal data is processed according to the relationship between you and and how personal data is processed by me. If you think there is any info missing, unclear or incorrect then please let me know so I can fix it.
PERSONAL DATA USE
- If you are a customer who wishes to book a photography session with me
You can get in contact with me using various social media outlets e.g. Instagram, Facebook
You can also get in contact using my web form, email address or my telephone number via WhatsApp for business. My website is hosted by Square Space and the domain is purchased from Lyrical.
Using any of these communication methods, you cannot confirm your booking with me unless you fill out the booking and consent form which will be emailed to you once we have agreed a date and time for the booking.

I will create a project on Dubsado which will log your booking and consent form along with payment details and progress of your booking e.g. date booked in

- If you are a customer and you have indicated on your booking form that you are willing for your photographs to be shared as a ‘sneak peek’ on any of Marley & the Wildlings platforms.
This will be documented in the booking form as a consent form. We will only share if you indicate this is okay. If you remove consent post sharing, we will cease and desist further sharing of your images, and will remove them from any further use but we cannot guarantee the images have not been shared further that are outside of our control e.g. Facebook’s terms and conditions.
If you do not want your ‘sneak peek’ via social media, they will be sent using email.

- If you have a complaint and wish to make a claim against Marley & the Wildlings / Lauren Heaton
Your information will be shared with my public liability insurance company and for the purpose of any proceedings arising out of such a claim. E.g. with my lawyers.

- If you are a client and your photos are ready
I have used Adobe Lightroom and Photoshop to edit your photos. Adobe uses cloud back up to share between my Apple devices.
I use Pic-Time to upload your photos to your own private online gallery. Pic-Time is a paid for service and I have a contract with them to show this.

- If you have indicated that you allow Marley & the Wildlings to use your photographs for marketing purposes
I use Canva to create marketing materials which I then share to my various social media platforms to encourage bookings.
STORAGE LOCATION
Both business and website data is stored in the UK and is back up by Apple iCloud in the UK. Where they have apps who we have contracts with to ensure your data is managed appropriately.
STORAGE LIMITATION
I will keep your personal data only for as long as I need it to meet the reasons we collected it, like following legal, tax, or reporting rules. If there’s a complaint or a chance of legal issues, we might keep it longer.
To decide how long to keep your data, we look at things like how much data we have, how sensitive it is, the risk of someone misusing it, and whether we can meet our needs in other ways. We also follow legal and tax rules.
In some cases, you can ask us to delete your data (see “Your legal rights” below for details).
Sometimes, we may remove personal details from your data so it can’t be linked to you. We might use this anonymous data for research or statistics forever without informing you.
YOUR RIGHTS

a right to erase any personal data that Marley & the Wildlings no longer has a legitimate purpose to process
a right of access to a machine-readable version of your data, as long as you have provided it or Marley & the Wildlings has observed it via your use of a service. This is legally only applicable to data provided with your consent or under a contract, but we will endeavour to give you a portable version of any of your data should time and technology allow it.

a right to prevent any wholly automated decisions involving your data – but rest assured, Marley & the Wildlings does not use wholly automated decision-making techniques

COMPLAINTS
If after contacting Marley and the Wildlings, you have not resolved your issue and you still have concerns about my handling of your personal data, contact the Information Commission. On contacting the IC, please use the registration ID as listed above at the beginning of this notice. See how to contact them via their website: www.ico.org.uk. In accordance with the new DUAA you will need to have contacted Marley & the Wildlings first before contacting the IC as we have the right to resolve your query first.
